Legislation or policies related to small and medium-sized enterprises (SMEs) in public procurement:
Summary:
The
Republic of Uzbekistan has several preferential public procurement laws for
Small and Medium Enterprises (SMEs). Following Decision N° PP1475 from the
President on the “Optimization of the Public Procurement System and Expanding
to Bring to Small Businesses”, the Cabinet of Ministers adopted several
preferential articles for SMEs in their public procurement resolutions. The
following selection of articles particularly concern SMEs:
- Article 4 of the Resolution of the Cabinet of Ministers on Measures to Improve the Legal Framework for the Organization of Public Procurement, states that the procurement body is responsible for determining quotas for SMEs, alongside to monitoring and implementing the quotas throughout the public procurement process in order to improve access for small businesses to obtain government contracts for goods, works and services.
- Article 55 of the Cabinet of Ministers Resolution on Measures to Improve the Organization of Tenders, clarifies that in situations where all bids are equal, preference should be given to SMEs.
- Article 27 of the Resolution of the Cabinet of Ministers on Additional Measures to Improve the Process of Government and Corporate Procurement highlights that certain goods and services are only reserved for small businesses.
