Summary:
Senegal’s
Public Procurement Code has several preferential clauses for Small and Medium
Enterprises (SMEs). Article 8 of the Code states that whenever it is
economically advantageous and feasible, contracts can be divided into smaller
lots to encourage SMEs to participate in the public procurement process. Also,
Article 48 clarifies that the contracting authority has the right to reserve up
to 40% of its contracts for capable SMEs that qualify for the work.
